Rules & Terms

The undersigned, the authorized representative of the project named below and throughout this application (hereafter called the “Project”) to India Global Short Film Festival (hereafter called the “Festival”), hereby represents that they have read, understood, and agreed to the following:

1. Authority and Permissions: The undersigned represents and warrants to the Festival that:

(a) They are duly authorized, on behalf of all persons or entities with ownership rights, licenses, or interests in the Project (collectively and separately hereafter called the “Project’s Owners”), to permit the Festival to exhibit this Project and to make the representations and warranties set forth herein.
(b) Exhibition of the Project at the Festival will not violate any law or any rights of any person or entity, whether such exhibition is live, digital, or a combination thereof.
(c) The Project is not subject to any threat of litigation, arbitration, or other claims or proceedings, including disputes regarding ownership of the Project.
(d) No agreements exist, nor will any be made, that would impair the ability to provide the Project as contemplated herein or conflict with any provisions of these Terms and Conditions.

2. Rights and Clearances: The undersigned further represents and warrants that:

(a). Exhibition of the Project at the Festival, whether live, digital, or a combination thereof, will not violate or infringe any copyrights, patents, privacy rights, publicity rights, trademarks, service marks, or any other personal or property rights of any person or entity.
(b). The Project does not and will not include any defamation of any person or entity.
(c). All license fees, clearance fees, and other obligations associated with the exhibition of the Project at or in connection with the Festival have been and will be paid in full.

3. No Confidential Relationship: If the Project is accepted for inclusion in the Festival:

(a). The undersigned acknowledges that the Festival’s exhibition or presentation of the Project does not create any confidential or fiduciary relationship between the Festival and the undersigned or the Project’s Owners.
(b). The undersigned further acknowledges that no compensation will be received for such exhibition, although some Festival prizes may include cash awards.
(c). The selection of the Project for inclusion in the Festival does not constitute an endorsement or approval of the content of the Project or any opinions expressed therein by the Festival.

4. Indemnification

The undersigned agrees to indemnify and hold harmless the Festival and its officers, directors, employees, attorneys, agents, licensees, volunteers, and representatives from any and all claims, losses, liabilities, damages, fees, and expenses (including reasonable attorneys’ fees) that may be incurred in connection with the Project or the Festival’s use, handling, consideration, or exhibition thereof.

5. Voluntary Submission

The undersigned warrants and agrees that the Project is being submitted voluntarily and without promise or inducement, and that the submission of the Project does not create any obligation on the part of the Festival to accept the Project for inclusion, to exhibit the Project, to acknowledge the submission, or to return any materials.

6. Waiver of Claims

By submitting the Project for consideration, the undersigned, the Project’s Owners, and any representatives or persons affiliated with the Project are waiving any right to assert any claim or commence any proceeding against the Festival based on the submission, selection, exhibition, or failure to select or exhibit the Project, including any claims relating to failure or refusal to exhibit the Project or any representations made by the Festival.

7. Limited Remedies

If any claim or action is brought in violation of these terms, the sole and maximum remedy shall be a refund of the submission fee. No other remedies, including actual, consequential, special, or punitive damages, or injunctive relief, shall be available.

8. Promotion Rights: If the Project is accepted, the undersigned grants the Festival the following rights without reservations:

a) To use footage, stills, titles, and information from or relating to the Project for promotional purposes.
(b) To issue and authorize publicity concerning the Project and all personnel related to the Project.
(c) To use the names, likenesses, and biographical information of all Project personnel in connection with the exhibition and promotion of the Project and the Festival.

9. Festival Benefits

If the Project is accepted, any "festival benefits" obligations to producers, distributors, creators, cast, or crew must be administered by the undersigned or the Project’s Owners, without impacting the Festival's provision of benefits.

10. No Guarantees

The Festival has made no claims, representations, or guarantees regarding the selection process, and submission does not create any obligation to provide comments or feedback.

11. Digital Assets

By submitting the Project, the Festival is granted the right to view and/or download all digital assets associated with the Project until the conclusion of the Festival. The Festival takes reasonable anti-piracy precautions, but the undersigned releases the Festival from liability in the event of theft, unauthorized access, or copying of the Project.

12. Legal Age

If the undersigned is under the legal age to enter contracts, the Festival must be provided with signed consent from a parent or legal guardian.

13. Dispute Resolution

Any claim or dispute arising out of or relating to the Project, the Festival, or these Terms and Conditions will be governed by the laws of India and submitted to binding arbitration in Chennai, Tamil Nadu, India.

14. Consultation with Attorney

The undersigned acknowledges the right to consult with an attorney regarding these Terms and Conditions and the Rules and Regulations for submitting a project to the Festival.

15. Community Agreement

The Festival promotes an environment free of harassment, discrimination, sexism, and threatening or disrespectful behavior. Violations may result in rescinding invitations or disqualifying the Project.

16. Rules and Regulations

The undersigned acknowledges reading and understanding the Rules and Regulations for submitting a project to the Festival, which supersede any other information obtained.

17. Acceptance of Terms

By submitting the Project, the undersigned and all Project Owners accept these Terms and Conditions. No oral representations or promises have been made.

If the Project is accepted, the Project Owners will enter into a Festival Participation Agreement incorporating these terms. The Festival reserves the right to rescind any acceptance invitations if the Festival Participation Agreement is not accepted.

1. Who can participate?

Films produced after January 1, 2022, are eligible for submission.

Works previously presented at foreign events are welcome.

All films must have English subtitles, even if the film is in English (with .srt format dialogue list attached).
